For a band like Stratovarius it shouldn't be a problem to find an adequate label. If the old label is officially bankrupt, yes. Otherwise any contract would still be in force. Yes, that's right. Sanctuary Rec. had to close some of their branches in last few years. But what does it have to do with nothing-happening around the band?
