Plagiarism

First of all Hi
I noticed something that shocked me the other day a band called "My Chemical Romance" are using the same logo as stratovarius im not sure if this breaks any copyright laws or not but i thought id bring it to someones attention seen as when that logo is seen now people wont relate to the band it actually belongs to.

The first one is too similar to the StratoLily... I wouldn't let them use it that way.

Can any band "own" a symbol?

I mean, any symbol can have variations&still be different.
If a band has a unique symbol&it belongs to them alone, and patented, I say, yeah, there is a trademark problem&maybe a copyright violation.
But, this is such a gray area.

I think they don't know Stratovarius
Yes, I guess they shouldn't use it...if Stratovarius has a trademark for it, they can request from My Chemical Romance (or whoever else) to stop using it.

I hope they'll do that!

There is no copyright for fleur de lys. It´s an ancient symbol....
With us it first appeared in my solo album cover back in 1993.

just out of curiosity what does the symbol stand for?
When i saw it at the Download Festival i got really excited thinking Stratovarius had randomly turned up... was so disappointed when it turned out to be another band

Fleur de lys is everywhere! It's even on the 20c stamps from Cyprus

Didn't you read DiVinci Code?

Its what the secret society Priory of Scion uses as their symbol.
Its alot more to it than that, of course, however. DiVinci Code is a totally fictional book although the Priory and Opus Dei were/are real groups.

It´s not actually a totally fictional book, but pretty much sums up Christianity/Vatican/Jesus and how he was made "divine" by the council of
Nicea to stop the riots. There are many books written about the true story of
Jesus and those are not tailored or censored to the needs of any particular religion or organisation.

I could be wrong but I think the band Clutch use it too, so it could have been them?

I have conducted some research on Internet and this is what I found about the Fleur de Lys. I translated word by word from French to English, so please, be indulgent.
Three thousand years ago, this flower was already used by the Assyrians as decoration and emblem. It was then found again in Ancient Egypt (symbol of power), in India, Greece, Rome and Gaulle (ancient country of France which used to include the actual France, Belgium and the North of Italy: I refer you to Asterix and Obelix for more details).
The Lys means “The flower of flowers”. For Greek people, the white Lys was the emblem of the “Universal Creation”. The Lys is to Occident what the Lotus flower is to Orient. The Lys symbolizes Purity. Called the “mariale” flower because dedicated to Virgin Mary (or Mother Mary?), this symbol is divine, pure and virginal.
It is in 507 A.D., under Clovis, first French Christian king that the first Fleur de Lys appeared on a flag. Progressively, we could see it on royal seals and armorial bearings. It is under French king Louis VII that it first appeared on a royal banner. After many years, the Fleur de Lys became the "Fleur du Roi" (The Flower of the King).
I guess we can say that French kings were the first ones to use it as an emblem and symbol in Europe. Since Quebec used to be a French colony (but is no more), I guess this is why it is now our emblem.

I think "copying" the symbol is okay, however using the exact same one is bad, like on the first picture. The other two were fine I think.

Second, I don't think the lily is copyrighted. Just check the NFL's New Orlean Saint's team logo.
Third:
This is Quebec's flag.
It's pretty much a common symbol all over the world.

Nobody can hold an ancient sign like this as copyrighted. Anyway sux the way bands as this thing called My chemical romance, uses the same sign as Strato.
