I'm beginning to think I may have started something I'm going to regret.

By the way... regarding the poll, it's Atari and Bandai. Wouldn't want you suing the innocent. :P

(... alright, innocent may not be the best term, but as far as this discussion goes they're legit.)

Rappers have no talent.
This is why they always use/steal samples made by great artists.

I wouldn't say that. It takes certain talents to Rap and/or make a Hip-Hop/Rap Album. I couldn't do it.

Welcome to the Stratovarius forum, where most anything can and will happen

Hmm. Now I'm confused. Maybe we should sue all three just to make sure!!

And while you're at it, sue the maker of Dragonball Z too!

If I remember correctly, it is Bandai who is responsible for DBZ games.
It cannot be Nintendo because Budokai is also available on PS2, PS3 (i think?) and Xbox360.

The ones in question (Budokai 1 and 2) were available for the PlayStation 2 console. They were later rereleased on the Nintendo Gamecube with mixed results.

The publishers are Dimps, Atari and Bandai, though. Sony and Nintendo didn't have anything to do with it directly. ^^

Hmm. It seems like it sold pretty OK. Well I don't have any energy left for legal battles at the moment. But maybe I should post a wanted ad in Craigslist New York, like this:

Hungry entertainment lawyer/ shark wanted

Do you have some time and energy to fight a winnable battle? Do you want to cut your teeth battling a huge corporation on behalf of a bunch of broke musicians?

We would be interested in a no-win no-fee arrangement. It would be a plagiarism case and it is very clear. Our opponent would be Nintendo. Sales of the infringing product are in the range 2 million.

Can you smell the blood in the water? Then please contact us. It will be fun.

What do you guys think, should I contact TT, the publishers, and the other guys, clear it with them, and let some NYC lawyer loose like a shark in the water? I changed this topic into a poll now. Twist my arm!!
Like the post before said its actually not Nintendo or Sony, they just get royalties for games being released on there consoles. Its a bit more complicated then oh! there fault! The games were released in 2002 and 2003 and a lot has changed in these companies.

The publisher of the games Atari was bought out by Infogrames. The 2nd publisher Bandi merged with Namco making Bandi Namco. The developer of the games "Dimps Corporation" is still around though.

Both games Dragon Ball Z: Budokai 1 and 2 have the same soundtrack so you probably are going to want to look into both of them. Oh and the Sales figures I gave were just for the total released on Sony's Playstation 2. I could not find how many were sold on Nintendo's Gamecube.

Who you are probably going to want to contact about this are the publishers now Infogrames and Bandi Namco.

I didn't mind the Budokai ripoffs, but that Lil Wayne one really pissed me off. I definitely think something should be done about that one.

From http://en.wikipedia.org/wiki/Lil_Wayne_discography

Lil' Wayne -- Tha Carter III
Released: June 10, 2008
Label: Cash Money/Young Money/Universal
BPI: Gold
CRIA: 2x Platinum
RIAA: 3x Platinum
U.S. Sales: 3,082,227
W.W. Sales: 3.4 Million

There's gold in them tharr' old Finnish power metal songs! Err.. I meant, platinum!

To be honest though, I think this song is only on some special edition of that album. And I have no idea if Universal cleared it with, er, Universal. Maybe I should write Julian (our intrepid London attorney who is versed in all matters Universal). But it would probably be a little bit bad form to call him before we have cleared the old debt Stratovarius owes him ...

Apparently this isn't the first time 'Lil Wayne has been sued for plagiarizing.

I say, once Stratovarius (or Timo Tolkki, whomever) is available to do something, a lawsuit should be filed. It is such an obvious copy of Anthem of the World (they didn't even do anything to change the sound) that not doing an action would be horrible.

So I'd say, once all legal things are settled, sue the fuck out of him.

. How close can music be without it being considered infringement? I know in classical music I have heard some of the same progressions of chords and melody in what seems like hundreds of songs and it seems every power metal band has songs in perfect fifths chord progressions and a melody that just scales over it or something.

I'm guessing you have never been involved in legal action in the music industry. It is a pain in the ass the like of which you would not be able to imagine in your wildest dreams. "Royal" pain in the ass does not even begin to describe it.

Regarding sample licensing etc, I have no idea what the normal rates would even be.

I get tired even imagining going thru with anything like this again in my life.

I have been a part of a legal action against a huge case of plagiarism at my local University, and I can definitely see how it can be a royal pain in the ass. I helped initiate the legal action against the plagiarizer by notifying the original author and helping countless long days with the original author to build a case, though I never did anything really "in court". But I worked a lot with lawyers and shit. But that in itself was annoying as hell.

But at the same time, the same author I helped with won, and she was exhausted by the end. But she said she had never been so satisfied in her life, and that the satisfaction of winning against the little cheat was more thrilling than anything.

But I don't know if the music industry is any worse than what she went through.

Do you think you would feel any different if it was your own personal music that was plagiarized rather than Tolkki's?

But I think there's a good side in this, this means that many famous people do listen Stratovarius :ola:

Or... it may just mean that it's a common thing to steal things from finnish artists? who knows...
