I did... and opinions like that don't really contribute to the conversation. At all. Please keep them to yourself. ;/

I'll assuming you were talking to Jens, Star. Personally, I'd be flattered, but at the very least I'd expect it to be labeled a remix or have some sort of mention of the original title somewhere rather than actually claiming it as their own song.

Star_Ocean wrote:I have been a part of a legal action against a huge case of plagiarism at my local University, and I can definitely see how it can be a royal pain in the ass. I helped initiate the legal action against the plagiarizer by notifying the original author and helping countless long days with the original author to build a case, though I never did anything really "in court". But I worked a lot with lawyers and shit. But that in itself was annoying as hell.

But at the same time, the same author I helped with won, and she was exhausted by the end. But she said she had never been so satisfied in her life, and that the satisfaction of winning against the little cheat was more thrilling than anything.

But I don't know if the music industry is any worse than what she went through.

Do you think you would feel any different if it was your own personal music that was plagiarized rather than Tolkki's?
Well then you know the general feeling. :)

If we take the Lil' Wayne situation, imagine that the "lil' cheat" was protected by a corporation with the size of a whole third world country (eg. Fiji is comparable). The corporation has the same business morals as the mafia. And it's administered about as well as a phone company.

Then you have to also imagine that a smaller company (let's call it Dysfunctuary, inc.) who originally bought your friend's text, itself was gobbled up by this same corporation (let's call it Fiji-CosaNostra-Verizon, inc.).

This was of course after the plagiarism, but in a way Fiji-CosaNostra-Verizon is (probably without knowing it) illegally using an asset it somehow would use legally. So a better target might be the author instead of the corporation. The problem is that you have no idea if licenses were actually issued or how much they should have paid in the first place.

Your first task would be finding out who at Fiji-CosaNostra-Verizon, inc. you should even contact. Next step would be to get this person or sub-agency to even reply to a registered mail.

Honestly, I'd be more inclined to go directly to small claims court in some US jurisdiction. Believe it or not, that tactic has sometimes been fruitful for some people.

I'd say the best course of action is to first call up the people find out about the tracks and if they are indeed Strato rip offs to just have them admit it publicly.

I'd say you should only sue them if they claim a "Vanilla Ice"

(for those that don't know a "Vanilla Ice" is to claim a beat is yours when in fact it was ripped off from another artist, in his case he ripped off a queen song.)

It's 100% clear to me that the Lil Wayne song uses Anthem of the World samples. Without even nulling the two mixes. (Quick and dirty way to do a correlation analysis)

I would bet anyone 1000 dollars on that.

Ok, maybe 100 dollars

It's funny in a way -- me and the other guys played on a triple platinum selling rap album

Anyway I'm too lazy to fuck around with this nulling mixes stuff. Besides, they are mpeg compressed. Best would be to have uncompressed wave files and try to null those.

The game issue is more about music perception. But i have been involved in plagiarism cases before. I believe also here it would be go over the bar, even though the bar is set quite high. Especially if you consider all that material as a whole, like the video in the original poster's message.

Actually if i think about it some more, honestly, I'd be more inclined to just staple myself in the knee for fun than get involved in more legal issues.

With the DBZ thing I'd say it's more of a flattery thing and that they meant it as a compliment by using Strato influenced music.

With lil wayne I don't know what the deal is with that one.

You know... on my first listen, this reminds me a lot of one of Symphony X's songs. I'd have to go through them to remember which.

It's one of the tracks off of Jens' site.

i think we can list any song ever created if we are going to find any two songs that both use notes

It's one thing if certain songs have similarities however in lil wayne's case he is clearly using the melody from anthem of the world.

i'd actualy love a database so i could find all songs in a genre that use certain techniqes. one example can be any song that uses VI,IV,I,V chord progressions and arpeggios with 16th notes

Naming yourself after Stratovarius on a Stratovarius forum... is that really relevant? XD

And sorry, that's true. Probably shouldn't have posted that Symphony X thing but it came to mind as soon as I visited Jens' site. :P I daresay I might be guilty of using some Strato-inspired segments in my own music... Visions namely.

About the Sum 41 thing.

I once saw video about this and the guy who made it also listed like 5 other songs that sound alike.

still waiting song has different notes in the melody and chord progression than forever free. I think people are getting very anal about this.

Yeah! You guys can make a hell lot of money!

And I did some re-search on the "Navigator" Song. As far as I know it isn't from one of Lil Wayne's Album. It was released on one of his Mix-tapes. Apperently the mix-tape is called "Around The World 2 (Weezy Edition)" released in 2007. And I don't think he made that much money with it since IIRC these mix-tapes are normaly given away for free.

"People"? I think you mean Stratovarius321000. :P

Seriously, enough of the YouTube links, we don't need to hear every little similarity. There are only so many simple chords and progressions and, sorry to say, a lot of the music I listen to that you lot might call metal has some pretty standard melodies now and then. (Ie, Cold Winter Nights)

... I could swear I remember hearing the tune from DragonForce's 'Heart of a Dragon' when I was 6, or something. Or maybe I'm the one who came up with it... in which case I suppose I should go and sue them about it.

I am listening to the song right now and yes, the thing also sounds pretty strangely familiar.

Heart of a Dragon is one of the longer melodies lines in power metal. It’s pretty much made to be like a cultural déjà vie ,or however that is spelled. For me its a sort of a defining sum of rpg game music and fantasy movie soundtrack

I suppose. But I distinctly remember the chorus tune itself, not just the feel of it, from somewhere before. Not that I'm trying to start another plagiarism case or anything, since the last thing this thread needs is more legal discrepancies.

On a completely unrelated sidenote, I lol'd when I tried this on XP and it actually worked.

I also think this is just starting to get ridiculous, I'm with the band members now, it's just way too much time wasted to even persue this thing.

I'm just saying that this really doesn't seem worth it unless lil wayne goes around saying "oh yeah this was an original beat I put together"
