To address all these issues first off Lars does own the Metallica name and he is the one who registered it, so there really is no way the other members could have kicked him out, Lars is basically like the Tony Iommi of that band in the fact that only he can release a Metallica album.
As far as Dave Mustaine goes I would say that it still sounds as if he's a little bitter about Metallica, we still get great music from him so I guess it's not a big issue, however one bit of advice I would give him is to not take stock in idle gossip(even if he's the one spreading it).

Wow. Also another guy on a german website told me about that. It seems that he really made up his mind. Actually nice to see. It still doesn't change my opinion about his voice. I still think he is one of the most overrated singers ever but it makes him a whole lot less annoying. I really liked the original Megadeth lineup- with Poland, Dave Jr. on bass, and Samuelson on drums. They kicked ass. Yes, but even if he says that, I think he will never sing on Speed Metal songs like in the 80's (I'm Alive, Twilight Of The Gods or Halloween for example). Unfortunately for Dave Mustaine he's always felt as if he's had to live in the shadow of Metallica, no matter what successes he has with Megadeth he feels as if Metallica will always be number one and he will always be number two.
In many of the old interviews with him he says that he felt betrayed by people who he thought were his best friends, apparently he has not gotten over that.

Sorry guys, but after listening to Metallicas stuff since 1996 he actually became my Number 1. And I think he is better than Kirk. Kirk is a great guitar player but I think Dave is better.

album sales =\= quality. It doesn't matter what one thinks of the album, but album sales =\= quality.
The first few Metallica and Megadeth Albums (KEA, RTL, MOTP and AJFA for Metallica and KIMB, PSBWIB, SFSGSW and RIP for Megadeth) are pretty much on the same level for me. The Metallica ones may be a bit better. Then both bands started to change their style (Metallica with The Black Album and Megadeth with CTE). I also like both of those albums although I think that again, Metallica may be a bit better. Then came Load and ReLoad. Well, I have to say that the Megadeth releases that followed also haven't been that good, but I still liked them while the Metallica Albums just were lame. Especially the shitty St. Anger. Then both bands came, sort of, Back to their Roots. Tallica with DM and Megadeth with TWNAH, TSHF, UA and propably Endgame. And I have to say that Megadeth's efforts are in my opinion better. To me sales don't matter. If I would go for sales, I would propably listen to Slipknot, Korn and Emo Crap like Bullshit for my Gayhotline and all the other stuff.

I’m sure he is proud that ragehead likes megadeth more than Metallica but in the big picture the success of Metallica over megadeth is not making him happy. I’m just saying that who we like more is a different conversation than who is more successful.

While Hammett can obviously play fairly well, some of his solos used to get on my nerves- his overuse of the CryBaby (wah-pedal) was particularly annoying, and he really wasn't that good with that device to begin with.
He sort of reminded me of a "metal by connecting the dots" type of soloist, with a few too many cliches.
To me, Metallica's most noticable feature was that they were driven by rhythm and the drums, and were good songwriters early on, until they started to become a parody of themselves. Hetfield is a better vocalist than Mustaine, but he is certainly no Ian Gillan or Robert Plant.
Don't get me wrong, Metallica certainly left their mark, and came along at a time when a Metallica was really needed during the rise of glam- which I used to refer to as aluminum, since it really wasn't metal anyway.
Mustaine, as I said, is bitter and has a chip on his shoulder, but that's his problem. It's not as bad as he seems to let on.
I was listening to a radio interview with Roger Waters a couple of years ago, and when asked if he hated Gilmour, Mason, and Wright, his former bandmates in Pink Floyd, he sarcastically replied; "hate is far too precious of a commodity for me to go around wasting it on that lot!"
Now that, my friend, is bitterness- even though he has had some regrets since then- after their one-off reunion at Live8 and the death of Rick Wright. Life is too short for that kind of silly shit.

Metallica didn't have a decent album since And Justice For All, while Megadeth had sort of a slip with Cryptic Writings and Risk. In total, Megadeth>>>Metallica. The last Megadeth album (United Abominations) blows to bloody chunks everything Metallica did since 1988.
And if Dave wasn't perpetually pissed off at everything, he wouldn't by able to write the songs he usually writes.

Ex-METALLICA guitarist Dave Mustaine stands by his claim that the band wanted to fire co-founder and drummer Lars Ulrich after the group finished touring in 1986 — but the plan was disrupted by the death of bassist Cliff Burton in a tour bus accident.
In a recent interview with RollingStone.com, reporter Greg Prato asked, "As far as you know, is it true that on the last METALLICA tour Cliff Burton was on before he died, the band was planning on firing Lars Ulrich at the tour's end?" Mustaine replied, "That's what Scott (Ian, ANTHRAX guitarist) told me. He said that when METALLICA got home, that James (Hetfield, frontman), Cliff and Kirk (Hammett, guitarist) were going to fire Lars."
However, Scott Ian (via webmaster Brent Thompson) refuted Mustaine's statement in a post on ANTHRAX's official Twitter profile, writing, "Story's not true. Little does anyone know but Lars actually owns the (METALLICA) name. Good luck ever kicking him out."
In an interview conducted yesterday (Thursday, August 6) with Classic Rock magazine's Dave Ling, Mustaine steadfastly stood by his story.
Classic Rock: Given that Scott Ian wasted little time in issuing a denial, do you now regret breaking the story about METALLICA's alleged proposed sacking of Lars Ulrich?
Mustaine: "No. It was something Scott told me. I was trying to help him promote his autobiography. I love Scott and would never do anything to hurt him — never. But it's what he told me and I know other people who’ve heard it, too. With all the things that are out there on the Net, I know that Scott's having a bad time. People are starting to say, 'We believe Dave and Scott's a liar. He lied about the thing with Dan [Nelson, the singer who controversially parted company with ANTHRAX].' That's the last thing I wanted. I love Scott. I wish I could just make this thing go away. But I didn't say it, he did."
Classic Rock: So how do you explain your role in all of this?
Mustaine: "Like I said, I was trying to help Scott. I wanted to say something that would make people think, 'Oh shit, I've got to have Scott Ian's bio.' I was not trying to make them think, 'Oh, Scott's a gossip,' or, 'Hey, don't believe Scott.' I'm really fucking mad that people are saying bad stuff about him."
